PERSONAL DATA PROTECTION

The company VINO LUDVIK s.r.o., as the controller of personal data, describes in this document how we protect your personal data, how we obtain it, how we use it, with whom we share it, how you can control its processing, the measures we use to protect your data, and the rights you have in connection with its processing.

WHAT DATA WE COLLECT

1. Data Collected When Purchasing via the E-shop

When registering and purchasing through the online store (e-shop) on our website www.vinoludvik.sk, we require data necessary to process your purchase. Mandatory data are those without which we cannot deliver your order, such as your first and last name, delivery address (street, house number, city, postal code, country), email address, telephone number, and the ordered items.

The legal basis for processing personal data is Article 6(1)(b) of the General Data Protection Regulation (GDPR). Processing your personal data is necessary for concluding a distance sales contract, fulfilling accounting and invoicing obligations, processing your order, handling complaints, or changes to the delivery address.

Recipients of your personal data include the delivery service provider SDS Smart Delivery Service SK, s.r.o., Dunajská 46, 811 08 Bratislava, Company ID: 45 487 880.

Our e-shop does not collect any information directly related to your bank accounts. All online payments are processed on the bank’s secure pages. We receive only confirmation of payment success or failure and limited identification data (such as name or account reference) to identify or refund payments if necessary.

We never obtain your login credentials or account balance. The only stored data related to payment cards concerns the “remember card” function, which is fully managed by the bank. Only the bank can link your card number to the anonymized identifier stored in our system.

2. Data Collected During Registration and Creation of a “My Account”

If you create a user account (“My Account”) on www.vinoludvik.sk, we process related data. Mandatory data include a username and email address for communication purposes. Optional data include first name, last name, phone number, profile photo, delivery address (street, house number, city, postal code, country), and payment method.

The legal basis for processing is Article 6(1)(a) GDPR – your consent. Consent is voluntary and may be withdrawn at any time, without affecting the lawfulness of processing prior to withdrawal.

If you place an order after creating an account and apply a discount, the legal basis becomes Article 6(1)(b) GDPR, and the conditions stated in the “Data Collected When Purchasing via the E-shop” section apply.

If required data is not provided, it will not be possible to conclude a loyalty program membership and/or purchase contract, nor to grant discounts on purchased goods or services.

3. Commercial Communication and Newsletters

With your consent, we store your email address to send commercial communications, newsletters, special offers, and event information. If you contact us, we store your name, contact details (address, city, postal code, country), and the message you send.

The legal basis is Article 6(1)(a) GDPR – consent. Consent may be withdrawn at any time via the “Unsubscribe” link or by emailing vinoludvik@vinoludvik.sk, without affecting the lawfulness of prior processing.

If required data is not provided, we cannot send you commercial communications or newsletters.

4. Use of Data for Other Purposes

We also use your data to ensure service security, respond to legal claims, comply with legal obligations, cooperate with supervisory authorities, and enforce or defend legal claims.

5. Cookies

For the purposes above, we use cookies and similar technologies (e.g., pixels). Cookies are small data files stored in your browser or device. Pixels are small images or code fragments that collect information and may store cookies.

Cookies may be session-based or persistent. They allow us to remember your preferences, improve usability, analyze website usage, and enhance user experience.

We use functional and technical cookies essential for website operation (login, cart storage, security). These do not require consent. Other cookies can be managed via browser settings or third-party tools such as optout.aboutads.info. Disabling cookies may limit website functionality.

6. Data Disclosure

We do not publish or sell your personal data. Data may be disclosed only:

1. At your request (e.g., delivery services),

2. To contracted processors acting on our instructions, including
   CEE Acquiring, Nexi Central Europe a.s., Nexi Group, and Stripe,

3. For legal reasons (courts, authorities, legal and accounting advisors).

7. Data Protection and Retention

We apply all necessary technical, organizational, and security measures to protect personal data. Data is stored in secured databases on dedicated servers.

Account data is stored for the duration of account existence. Order data without account creation is stored for up to 5 years after delivery. Newsletter and consent-based data are stored until consent is withdrawn. Legitimate interest data is stored until the purpose ceases, unless another legal basis applies.

8. Your Rights

You have the right to access, correct, delete, restrict, and transfer your personal data, and to object to processing, especially for direct marketing. Requests are handled within 30 days, extendable to 60 days if justified.

You may exercise your rights via email or written request. Identity verification is required to prevent unauthorized access.

9. Filing Complaints

If you believe your personal data is processed unlawfully, you may file a complaint with the Office for Personal Data Protection of the Slovak Republic.
